OurVoice is an Australia-based social platform designed to enable citizens to discuss public policy options and issues. Our goal is to provide Members of Parliament with a clear understanding of the views and opinions of their electorate, in order to empower them to better represent their voters. OurVoice is owned and operated by Our Voice Pty Ltd (ABN 94 662 459 136) with the website domain itsourvoice.com.

Acceptance of Terms

By accessing and using the OurVoice platform, you agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree to these Terms and Conditions, you should not use the OurVoice platform.

User Accounts

You must create an account to use the OurVoice platform. You agree to provide accurate and complete information when creating your account, and to update your information as necessary. You are responsible for maintaining the confidentiality of your account information, including your password, and for any activities that occur under your account.

User Conduct

You agree to use the OurVoice platform in a manner that is lawful, ethical, and respectful of others. You agree not to post or transmit any content that is illegal, offensive, defamatory, or otherwise objectionable. You also agree not to engage in any activity that interferes with the operation of the OurVoice platform or that compromises the security or integrity of the platform.

Intellectual Property

The content and materials on the OurVoice platform, including but not limited to text, graphics, logos, and images, are the property of Our Voice Pty Ltd or its licensors and are protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or display any content from the OurVoice platform without the prior written consent of Our Voice Pty Ltd.

Use of the Website

  1. By using OurVoice, you agree to only use the website for lawful purposes and in accordance with these terms and conditions.

  2. You agree not to use the website:

    1. in any way that violates any applicable federal, state, local, or international law or regulation;

    2. for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise;

    3. to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation;

    4. to impersonate or attempt to impersonate OurVoice, an OurVoice employee, another user, or any other person or entity (including, without limitation, by using e-mail addresses or screen names associated with any of the foregoing); or

    5. to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the website, or which, as determined by us, may harm OurVoice or users of the website or expose them to liability.

Registration and User Accounts

  1. In order to use OurVoice, you may be required to register and create a user account. You agree to provide accurate, current, and complete information during the registration process.

  2. You are responsible for maintaining the confidentiality of your account login information, and you agree to accept responsibility for all activities that occur under your account.

  3. OurVoice reserves the right to refuse registration of, or cancel, any account for any reason in its sole discretion.

Content

  1. OurVoice is not responsible for user-generated content posted on the website. You understand that when using the website, you will be exposed to user-generated content from a variety of sources and that OurVoice is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such content.

  2. You agree that you will not upload, post, transmit, or otherwise make available any user-generated content that:

    1. is unlawful, harmful, threatening, abusive, harassing, defamatory, libellous, invasive of another's privacy, or is harmful to minors in any way;

    2. infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party;

    3. contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment; or

    4. is deemed to be illegal, or to promote illegal activities.

  3. You retain ownership of any content that you post or submit to the OurVoice platform, but you grant Our Voice Pty Ltd a non-exclusive, worldwide, royalty-free license to use, copy, distribute, and display your content on the platform. You represent and warrant that you have the right to grant this license and that your content does not infringe the intellectual property rights of any third party.

Data Collection and Use

  1. OurVoice collects and uses data from users in order to provide a more personalized experience and to better serve the needs of users.

  2. OurVoice reserves the right to collect and use data from users in order to provide insights and analysis to elected officials and Members of Parliament.

  3. OurVoice will never sell user data to third parties.

Intellectual Property

  1. The content on the OurVoice website, including all text, graphics, images, logos, and software, is the property of Our Voice Pty Ltd or its respective owners and is protected by Australian and international copyright and trademark laws.

  2. You agree not to reproduce, modify, distribute, or otherwise use any of the content on the website without prior written consent from Our Voice Pty Ltd.

  3. Any unauthorized use of the website's content may violate copyright, trademark, and other laws and may result in legal action.

Limitation of Liability

  1. OurVoice is not responsible for any direct, indirect, incidental, special, or consequential damages resulting from your use of the website or any user-generated content posted on the website.

  2. OurVoice makes no representations or warranties of any kind, express or implied, as to the operation of the website or the information, content, materials, or products included on the website.

Community Moderation

Some Members are provided with additional account features to use to support their community, including moderation tools. WE ARE NOT RESPONSIBLE FOR THE ACTIONS TAKEN BY THESE MEMBERS WHILE USING THESE ACCOUNT FEATURES.

We reserve the right to overturn any action taken by these Members if we, in our sole discretion, believe that such action is not in the interest of OurVoice. We reserve the right to revoke or limit a Member's access to these tools at any time, with or without notice, for any reason or no reason, including for a breach of these Terms or any relevant policies or guidelines. If you are given access to these additional account features, including moderation tools, then:

  1. You agree that you are taking all actions related to community moderation on a volunteer basis and are not an employee or contractor of OurVoice;

  2. You may not represent that you are authorised to act on behalf of OurVoice;

  3. You may not enter into any agreement with a third party on behalf of OurVoice;

  4. You may not perform moderation actions in return for any form of compensation, consideration, gift, or favour from third parties; and

  5. If you have access to any non-public information through these account features, then you will use such information only in connection with your role as a volunteer.

Prohibited Conduct

Without limiting other restrictions contained in these Terms, you agree that you will not, under any circumstances

  1. gain or attempt to gain unauthorised access to any part of the Services, including the Accounts of other Members (such through the use of bots or other automations as well as the unauthorised use of legitimate Member credentials);

  2. interfere with, disrupt, or damage our Services or attempt to do the same (such as by posting viruses, instigating a denial of service attack, or spamming Members);

  3. attempt to gain access to or tamper with non-public areas of the Services, our computer systems, and any technical delivery systems of our providers;

  4. attempt to prove, scan, or test the vulnerability of our systems, networks, or Services, or breach any security or authentication measure;

  5. conduct facial recognition or other biometric analysis of the Content (as defined below) posted on OurVoice;

  6. develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins, and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services; or

  7. otherwise access or use the Services in an unlawful or unanticipated manner. For clarity, any attempt to engage in any of the behaviours listed in this section is also prohibited.

Disputes Between Members; Waiver of Claims Against OurVoice.

In the real world and online, people sometimes disagree. If you have a dispute with another Member, we hope that you will be able to work it out amicably. However, if you can't, please understand that OurVoice is not responsible for the actions of our Members. Each of our Members is solely responsible for their own actions and behaviour, whether they are using OurVoice or discussing matters with a neighbour at a local park. Accordingly, you agree that OurVoice has no responsibility for the conduct of Members or other third parties and, to the maximum extent permitted by applicable law, you hereby release the OurVoice Entities (defined below) from losses, liabilities, claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with disputes involving you and other Members.

Disclaimer of Warranties

The OurVoice platform is provided on an "as is" and "as available" basis. Our Voice Pty Ltd makes no representations or warranties of any kind, express or implied, regarding the operation or availability of the platform or the content, information, or materials on the platform. To the fullest extent permitted by law, Our Voice disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by law, Our Voice Pty Ltd will not be liable to you or any third party for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the OurVoice platform, including but not limited to loss of profits, data, or other intangible losses, even if Our Voice Pty Ltd has been advised of the possibility of such damages.

Modification of Terms

Our Voice Pty Ltd reserves the right to modify or update these Terms and Conditions at any time without prior notice. Your continued use of the OurVoice platform after any such changes constitutes your acceptance of the new Terms and Conditions.

Termination

Our Voice Pty Ltd may, in its sole discretion, terminate your access to the OurVoice platform at any time, for any reason, and without prior notice.

Governing Law and Jurisdiction

These Terms and Conditions and your use of the OurVoice platform will be governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these Terms and Conditions or the use of the OurVoice platform will be subject to the exclusive jurisdiction of the courts of Australia.

Changes to the Terms and Conditions

Our Voice Pty Ltd reserves the right to modify or update these terms and conditions at any time without prior notice. Your continued use of the website after any changes to the terms and conditions constitutes your acceptance of such changes.

Entire Agreement

These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and Our Voice Pty Ltd with respect to your use of the OurVoice platform.
